Kiddikicks Conditions
1. Definitions
Carer means you or the person chosen by you to attend the Class with the Pupil;
Enrolment Form means the form for enrolling the Pupil for Classes with Kiddikicks, which you have completed and signed;
Fee means the price of the Classes, as applicable from time to time;
Kiddikicks, we or us means Kiddikicks Sports Limited, 26 Thackeray Street, London W8 5ET;
Premises means the place where the Class takes place;
Pupil means the child named on the Enrolment Form;
Teacher means the person employed by Kiddikicks to teach the Classes;
Term means a period of 6 or 12 weeks (as applicable), starting with the first Class of that period; and
You means the parent or legal guardian who has signed the enrolment form for a Pupil and is responsible for the payment of the Fees for that Pupil and your shall be construed accordingly.
- Responsibility
- You confirm that you are the parent or legal guardian with responsibility for the Pupil. You agree that you or a Carer will attend each Class with the Pupil unless expressly agreed in advance with us on a “Class by Class” basis.
- You confirm that the information set out in the Enrolment Form is accurate in all material respects and that you will inform us of any changes immediately.
1.3. You acknowledge that the Pupil will be under the supervision, care and control of a Carer at every Class and that the Carer will be responsible for the welfare and conduct of the Pupil whilst the Pupil is on the Premises.
1.4. Some Classes may be held outdoors in public spaces which have been carefully selected by Kiddkicks. During such Classes the Carer shall be responsible for the whereabouts of the Pupil and shall take special care to ensure that the Pupil stays within the boundaries demarcated by Kiddikicks.
- You will indemnify us and keep us indemnified against all loss, liability, costs and expenses which we may incur directly as a result of any actions of a Carer or the Pupil.
- Discipline
If we decide that the Pupil’s or Carer’s behaviour is unacceptable, we are entitled to exclude the Pupil and/or the Carer from a Class or the Premises for any period that we may decide is appropriate. Unacceptable behaviour shall include damage to property, disruptive behaviour, aggression towards the Teacher or other pupils, or any other behaviour as we reasonably determine.
- Fees and Payment
- You shall pay us the Fees for a complete Term at any time before the first Class of that Term.
- Subject to clause 4, the Fees payable at the start of a Term for a complete Term shall be non-refundable.
- No credit shall be given for Classes which have been missed by the Pupil in exchange for future Classes.
- Cancellation or Changes
- We may cancel this contract at any time before the start of any Term. In such event we will refund the Fees paid for that Term.
- We may change these conditions at any time, including the location and times of the Classes. We will endeavour to give you as much notice as possible in the event of any changes. If you do not agree to the changes, we will refund the Fees for any outstanding Classes.
- Exclusion of liability
- Kiddikicks accepts responsibility to you, the Pupil or the Carer for any direct loss suffered by that person (however caused) but not for any indirect or consequential loss or damage however caused, even if we were advised of the possibility of such loss.
- You agree that any claim against Kiddikicks must be brought within 3 months of the event resulting in such claim.
- Kiddikicks’ maximum liability to you and/or the Pupil and/or the Carer shall be limited to the total amount of Fees paid.
- General
- The failure by either party to enforce any of these conditions shall not be a waiver of them.
- These conditions, together with the Enrolment Form, constitute the entire agreement between you and Kiddikicks.
- You agree that these conditions will apply to the Classes run by Kiddikicks and attended by the Pupil. By making payment of the Fee and the Pupil attending the Class, you are deemed to have accepted these conditions.
- These conditions shall be governed by English law and shall be subject to the jurisdiction of the English courts.
